The lawyers act under the brand name "arcum RECHTSANWÄLTE". However, they are not associated with each other under company law (in particular not as a partnership under civil law), but only in an office partnership, each acting independently as an individual lawyer (sole proprietor) and with sole responsibility. In the event of a joint mandate, this will be discussed and agreed with the client before the mandate is awarded.

The professional title "Rechtsanwalt" was awarded in Germany. The lawyers of arcum RECHTSANWÄLTE are members of the Munich Bar Association, Tal 33, D - 80331 Munich, Tel: 089 - 5329440, responsible for the Oberlandesbezirk Munich. Benoît Laurin is a member of the Munich Bar Association as a so-called European lawyer. At the same time, he is admitted as Avocat au Barreau de Paris at the Chambre des avocats de Paris.

All lawyers of "arcum RECHTSANWÄLTE" are subject to the professional regulations of the Federal Lawyers' Act of 1 August 1959 (BGBl. I 565) (BRAO) and the Lawyers' Fees Act of 5 May 2004 (BGBl. I 718) (RVG) in the respectively applicable versions as well as the Professional and Specialist Lawyers' Regulations of the Federal Chamber of Lawyers of 22 March 1996 (BRAK-Mitt. 1996, 241) (BORA and FAO) in the respectively applicable versions. Lawyers are obliged by the Federal Lawyers' Act to maintain professional liability insurance with a minimum insurance sum of 250,000 EUR. Details can be found in § 51 BRAO.

Our sum insured exceeds the minimum sum insured according to § 51 BRAO.

The insurance cover does not apply to liability claims arising from activities:

  • via law firms or offices established or maintained outside the Federal Republic of Germany;
  • in connection with advice and employment with non-European law;
  • from the activities of lawyers before non-European courts.

We provide our services on the basis of a "contract for legal services". This is available in our offices.
Unless otherwise provided by law, we agree Munich as the place of jurisdiction and the applicability of German law.

We aim to conclude a remuneration agreement (§§ 3a ff. RVG) or a fee agreement (§ 34 RVG). Otherwise, we shall invoice the value of the object on the basis of the statutory provisions of the Lawyers' Fees Act.

Competent consumer conciliations board:
For property disputes arising from the mandate relationship the conciliation board the Bar Association Munich, Tal 33, 80331 Munich, www.rak-muenchen.de, shall be competent. The lawyers are willing to participate in dispute resolution proceedings at the conciliation board of the munich Bar Association.

Information on the Online Dispute Resolution Platform of the European Commission: Contracts that a lawyer concludes with a client who is a consumer via the lawyer's website or by other electronic means are online service contracts. In the event of disputes arising from such an "online lawyer contract", the consumer can therefore use the OS platform for out-of-court solutions. The Platform for Online Dispute Resolution (OS Platform) of the European Commission can be reached at http://ec.europa.eu/consumers/odr/.
